The role and structure of the Covenants Committee (CC) is defined in the Covenants and Guidelines of West Meadows. When a violation of the Covenants or Guidelines is noticed by or brought to the attention of the Property Manager, the violations process is initiated. If, after two notification letters, the violation is not remedied, the Property Manager may refer the matter to the CC or to the Board of Directors for approval of legal action against the violator.

Committee Membership:
The CC consists of three voting members (chairperson, plus two other voting members) and two alternates. Attendance by and participation from all members is actively encouraged.

Prior to the meeting, members are given information regarding the violations scheduled to be heard during the meeting. Often this briefing includes pictures and a discussion of what, if any, interaction has been had with the homeowner. All homeowners whose cases are heard before the committee are given the opportunity to appear before the committee and explain the situation. The committee chair and members will often ask questions of the homeowner. After all homeowners are heard, the committee discusses each case, and makes decisions regarding what action to take. Action may include doing nothing, direction to submit to the Architectural Control Committee, or referring the matter to legal counsel for enforcement. If an Owner does not agree with the Committee's decision, the matter may be appealed to the West Meadows Board of Directors and with notice to the Board, the appeal will be heard at a regularly scheduled Board meeting.
Comments:
There are a few things that fall outside the CC’s scope. For instance, the CC is not the appeals board for ACC decisions. ACC decisions requiring appeal need to be directed to the West Meadows Board of Directors.
The CC does not administer violations prior to the notice to appear before the CC. If a homeowner notices a violation of the restrictive covenants, he or she should report this to the Property Manager.
The CC does not have the authority to amend the documents or covenants of West Meadows. Modifications require Board of Directors approval and a community-wide vote in which more than half the residents must participate and vote for approval.
