RULE 1: SIDEWALK – MAILBOX BLOCKING 

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 JURISDICTION – ALL SIDEWALKS AND MAILBOXES IN WEST MEADOWS  RULE 1.  SIDEWALK – MAILBOX BLOCKING  The sidewalks of West Meadows were designed for pedestrian use only. Sidewalks were never intended for the storage/parking of automobiles or to be blocked by the storage of any other personal property.  Pedestrian use includes walkers, joggers, runners, roller skaters, bicyclists, scooters, skateboarders, baby carriages and other human powered devices not powered by electricity, steam, wind or an internal combustion engine set forth as illustration and not by way of limitation.  Blocking of the sidewalk, by a member and/or his guests/tenants, AT ANY TIME either fully or partially, permanently or temporarily, by parking a motor vehicle, motorcycle, boat, or trailer across a sidewalk and/or leaving any personal property upon the sidewalk - is prohibited  Parking on the street, by a member and/or his guests/tenants, in front of or near a mailbox so as to block or impede the delivery of mail is prohibited.

RULE 2: STREET PARKING AND INOPERABLE VEHICLES

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and. operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

JURISDICTION – ALL STREETS WITHIN WEST MEADOWS 

RULE 2.  STREET PARKING AND INOPERABLE VEHICLES

 

Members and their guests/tenants are prohibited from parking a motor vehicle or trailer, motorcycle on/in the streets of West Meadows in excess of four (4) continuous hours. Vehicles parked in repeated violation of this Rule are subject to towing. 

 

Parking a motor vehicle and/or trailer anywhere on the common grounds of West Meadows and/or upon any homeowner lot with its wheels wholly or partially upon grass and/or landscaping is prohibited. 

 

Any automobile, trailer or motor vehicle parked with its wheels wholly or partially on the grass or landscaping of the common property of the Association is subject to towing. 

 

Only operable vehicles with current license plates, registration and statutory insurance coverage may be operated on the streets of West Meadows and/or parked/stored on any lot.  Any other vehicle must be stored inside a residential garage with the garage door completely closed. 

 

This rule supersedes and revokes any prior Rule and or Regulation regarding the subject matter except any matter contained in the Declaration of Covenants.

RULE 3: TOWING

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

JURISDICTION – ALL STREETS AND SIDEWALKS WITHIN WEST MEADOWS.

 

RULE 3.  TOWING

 

In addition to other enforcement remedies that the Association may have with regard to the repeated violation/s of the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, regard to street and sidewalk parking; TOWING, after reasonable notice, may be employed as a violation enforcement remedy. 

 

The following procedure shall be employed when towing vehicles in repeated violation of RULES 1 AND 2. 

 

·        Upon observance of a violation of RULE 1 AND/OR 2, a Member of the Board of Directors and/or the Community Association Manager may complete in duplicate a form known as FINAL NOTICE BEFORE TOWING and attach one of the completed forms to the violating vehicle underneath the driver side windshield wiper and file the other completed form in the Community Association Manager’s TOWING BOOK.  A specimen of a FINAL NOTICE BEFORE TOWING is attached hereto for reference.

 

·        Upon a subsequent observation of a violation of RULE 1 AND/OR 2 by the same vehicle, 24 hours subsequent to the issuance of the FINAL NOTICE BEFORE TOWING, a Member of the Board of Directors and/or the Community Association Manager may summon the towing company with which the Association contracts and authorize the violating vehicle to be towed and impounded pursuant to Florida Statute 715.07.  The Member of the Board of Directors and/or the Community Association Manager shall make notation on the Association’s copy of the FINAL NOTICE BEORE TOWING of the date, time and circumstances surrounding the tow.

 

This rule supersedes and revokes any prior Rule and/or Regulation previously adopted regarding the subject of towing.

RULE 4: FISHING

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

JURISDICTION – ALL BODIES OF WATER, PONDS, LAKES AND RETENTION PONDS PERMITTED AND/OR OWNED BY WEST MEADOWS PROPERTY OWNERS ASSOCIATION, INC.

 

 

RULE 4.  FISHING

 

 

The Board of Directors at its July 19, 2011 Meeting reaffirmed that the Common Property of the Association is dedicated to the common use and enjoyment of the Owners and enacted the following rule regarding fishing in the Association’s bodies of water, ponds, lakes and retention ponds:

 

Fishing in the bodies of water, ponds, lakes and retention ponds is limited to Owners/tenants and their immediate live-in families only.  An Owner’s/tenant’s guest may enjoy fishing only if the Owner/tenant is personally present with the fisherman.  Fishermen shall respect the privacy and property of other Owners/tenants adjoining and/or near the bodies of water, lakes, ponds and retention ponds by not entering upon lands other than the common property of the Association, and by maintaining proper decorum in terms of behavior, noise and trash/debris disposal.   

 

The only fishing allowed in the bodies of water, ponds, lakes and retention owned and/or permitted by West Meadows Property Owners Association, Inc. IS CATCH AND IMMEDIATELY RELEASE ALIVE.   Fish may not be intentionally killed/harvested or removed from the bodies of water, lakes, ponds and retention ponds of West Meadows Property Owners Association, Inc. for purposes of consumption and/or mounting

RULE 5: TRADEMARK

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

 

 

RULE 5.  Trademark

 

 

The letterhead sand crane with other accent design features is a registered trademark owned by the West Meadows Property Owners Association, Inc. and may not be duplicated, transmitted, distributed, posted, disseminated or used in any form for any purpose without the express, written permission of the Board of Directors of West Meadows Property Owners Association, Inc.  Should express written permission be granted by the Board of Directors of West Meadows Property Owners Association, Inc., said permission may also be withdrawn or cancelled at anytime and for any reason that the Board of Directors of West Meadows Property Owners Association, Inc. in its sole discretion, deems appropriate and/or necessary.  Said revocation shall be also transmitted in writing.  This Rule shall be incorporated into and made a part of any license regarding the use of the Trademark.

RULE 6.  Trailers, Boats, RVs and Portable Storage Containers


Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

 

 

RULE 6.  Trailers, Boats, RVs and Portable Storage Containers

 

 

No boat of any style or size, no trailer of any style or size and no recreational vehicle of any style or size may at any time be parked or stored upon any street , sidewalk, driveway, anywhere on any lot, on grass, common property or private property in West Meadows unless completely screened from view from the street or from any neighboring lot  - by any Owner, tenant, member of Owner’s family or guest of any owner.  Boats, trailers, inoperative vehicles and or recreational vehicles may only be parked/stored inside a residential garage with the garage door completely closed.

 

No portable storage container (commonly known as a POD) may be stored or placed on any lot in excess of four (4) days.

RULE 7: STORAGE OF PERSONAL PROPERTY

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

 

 

RULE 7.  Storage of Personal Property

 

 

Storage of barbecue grills, lawn mowers, lawn care tools, bagged products such as fertilizer and/or mulch, bicycles, building products and materials, ladders and other personal property, when not in use, is limited to the interior of the garage with the garage door completely closed or completely screened from view from the street or from any neighboring lot.  Examples mentioned previously and elsewhere in the text of this Rule are by way of illustration and not by way of limitation. 

 

Trash receptacles are to be brought out and placed beside the street for pick-up only on the scheduled pick-up day and removed the same day - at all other times stored completely screened from view from the street or any neighboring lot.     

 

No portable storage container (commonly known as a POD) may be stored or placed on any lot in excess of four (4) days without an approved ACC Application. 

 

Propane tanks, and/or water conditioning tanks must be screened from view from the street or any neighboring lot.  Water barrels or other containers used for the collection of roof run-off and/or rain collection must be completely screened from view from the street or any neighboring lot.  Water conditioning and pool filtration/circulation machinery/plumbing, and air conditioning condensers  shall be completely screened from view from the street or any neighboring lot by landscaping of appropriate size, a masonry wall  with approved painting, or approved fencing.  .

RULE 8: PETS

Pursuant to the authority of the Board of Directors to make and adopt additional rules and regulations relating to the use, maintenance and operation of the SUBJECT PROPERTY contained in the DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR WEST MEADOWS, Article XII, Paragraph G., the Board of Directors makes, adopts and promulgates the following Rule and Regulation:

 

 

 

RULE 8.  Pets  

 

No dog houses or outside structures of any kind designed for the exercise, shelter or restraint of pets are allowed in West Meadows including but not limited to cages and/or other containment devices.   Dogs and pets are to be under the direct control and supervision of their owners at all times.  Dogs are not to be left unattended out of doors while the owner is not at home regardless of whether they are in a fenced area.  Clothesline runs are prohibited in West Meadows.  Dogs may not be chained, staked or leashed to a tree or other object unattended.

 

This Rule supersedes and revokes any other inconsistent and/or conflicting Rule or portion of an inconsistent and/or conflicting Rule - previously enacted.
